Laki oikeudenkäynnistä rikosasioissa (689/1997), 1 luku 2 § — Syyttäjän tehtävä

FINNISH CRIMINAL PROCEDURE ACT Laki oikeudenkäynnistä rikosasioissa (689/1997), 1 luku 2 § Current consolidated statute · Chapter 1, Section 2 Suomenkielinen säädösteksti Syyttäjän tehtävänä on nostaa rikoksesta syyte ja ajaa sitä. Syytteen nostamisen edellytyksistä säädetään 6 §:n 1 momentissa. Lisäksi noudatetaan, mitä asianomistajan syyttämispyynnöstä ja muista erityisistä syytteen nostamisen edellytyksistä muualla laissa säädetään. English translation The duty of the prosecutor is to bring charges for an offence and to pursue the charges. The prerequisites for bringing charges are laid down in section 6(1). Provisions laid down elsewhere by law on a request of an injured party for the bringing of charges and on other special prerequisites for bringing charges also apply. The English translation follows the Ministry of Justice’s published translation of the Criminal Procedure Act; the translation is legally binding only in Finnish and Swedish. Legal context This section defines the prosecutor’s core procedural role. It must be read together with section 6 on the threshold for bringing charges, the provisions on waiver of charges, and any offence-specific requirement for a victim’s request for prosecution. It does not permit the prosecutor to assume that a required complaint or request exists without checking the relevant case materials where that requirement matters. Esitutkintalaki (805/2011), 10 luku 1 § — Loppulausunto ennen esitutkinnan päättämistä

FINNISH PRE-TRIAL INVESTIGATION ACT Esitutkintalaki (805/2011), 10 luku 1 § — Loppulausunto Current consolidated statute · Chapter 10, Section 1 Suomenkielinen säädösteksti Ennen esitutkinnan päättämistä asianosaisille on varattava tilaisuus antaa esitutkintaviranomaiselle loppulausunto esitutkinta-aineiston riittävyydestä, näytön arvioinnista, oikeuskysymyksistä tai muista asian käsittelyn kannalta tärkeistä seikoista, jollei lausunnon pyytäminen ole asian laatu ja laajuus, rikoksen vähäisyys tai muut vastaavat seikat huomioon ottaen syyteharkinnan ja tuomioistuinkäsittelyn kannalta ilmeisen tarpeetonta. Loppulausuntopyyntö on yksilöitävä. (17.4.2026/269) English translation (unofficial) Before the pre-trial investigation is concluded, the parties must be given an opportunity to submit a final statement to the pre-trial investigation authority on the sufficiency of the investigation material, the assessment of evidence, legal questions, or other important matters relevant to the handling of the case, unless requesting a statement is clearly unnecessary for consideration of charges and court proceedings in view of the nature and scope of the matter, the minor nature of the offence, or comparable circumstances. The request for a final statement must specify the matters to be addressed. Sufficient time must be allowed for the person submitting the statement to familiarise themselves adequately with the case, without unnecessarily delaying its handling. After receiving the statement, the authority must consider whether the investigation can be concluded or whether the statement gives reason to supplement the investigation. The investigation leader decides, in cooperation with the prosecutor, whether to request a final statement and what measures that may require. The duty of the investigation authority and prosecutor to consult on the final-statement procedure is governed by Chapter 5, section 3. This English translation is unofficial. The Finnish statutory text is authoritative. Legal context The current wording was amended by Act 269/2026. Compared with the earlier wording, the current section requires the request for a final statement to be specified, requires the authority to consider whether the investigation can be concluded or should be supplemented, and requires the investigation leader to decide in cooperation with the prosecutor. Chapter 5, section 3 separately governs the consultation duty. Esitutkintalaki (805/2011), 5 luku 2 § — Syyttäjän toimivaltuudet esitutkinnassa

FINNISH PRE-TRIAL INVESTIGATION ACT Esitutkintalaki (805/2011), 5 luku 2 § — Syyttäjän toimivaltuudet esitutkinnassa Current consolidated statute · Chapter 5, Section 2 Alkuperäinen säädösteksti Esitutkintaviranomaisen on syyttäjän pyynnöstä toimitettava esitutkinta tai suoritettava esitutkintatoimenpide. Esitutkintaviranomaisen on muutenkin noudatettava syyttäjän määräyksiä, joilla pyritään turvaamaan asian selvittäminen 1 luvun 2 §:ssä tarkoitetulla tavalla. Syyttäjä päättää esitutkintatoimenpiteistä asian siirryttyä hänelle esitutkinnan päättämisen jälkeen. Syyttäjän toimimisesta tutkinnanjohtajana säädetään 2 luvun 4 §:ssä. English translation — unofficial At the prosecutor’s request, the pre-trial investigation authority must conduct a pre-trial investigation or carry out an investigative measure. The authority must also comply with the prosecutor’s directions intended to ensure that the matter is clarified in the manner referred to in Chapter 1, section 2. After the matter has been transferred to the prosecutor following the conclusion of the pre-trial investigation, the prosecutor decides on investigative measures. Section 4 of Chapter 2 governs the prosecutor’s role as investigation leader. This English translation is unofficial. The Finnish statutory text is authoritative. What this provision means This section contains more than a power to request an investigative measure. It also requires the investigation authority to comply with the prosecutor’s directions aimed at ensuring that the matter is sufficiently clarified under Chapter 1, section 2. It separately addresses who decides on investigative measures after the investigation has concluded and the matter has been transferred to the prosecutor. Chapter 1, section 2 describes the matters that must be clarified in an investigation, including the suspected offence and its circumstances, relevant parties and other matters needed for consideration of charges and consequences. This section does not mean that the prosecutor personally performs every investigative act; the legal roles and the stage of the proceedings matter. Esitutkintalaki (805/2011), 3 luku 3 § — Esitutkinnan toimittaminen

English translation — unofficial A pre-trial investigation authority must conduct a pre-trial investigation when, on the basis of a report made to it or otherwise, there is reason to suspect that an offence has been committed. Before starting the investigation, the authority must, where necessary, clarify the circumstances relating to the suspicion of an offence, in particular to avoid unjustifiably placing anyone in the position of a suspect and to enable a decision under section 9(1) or section 10(1), where appropriate, not to conduct an investigation. This is an unofficial translation. The Finnish statutory text is authoritative. What this provision means The legal trigger is that there is reason to suspect an offence has been committed. The law also requires preliminary clarification where necessary. The authority must distinguish between the threshold for beginning an investigation and the later assessment of whether the evidence justifies charges. Sections 9 and 10 govern specified situations in which an investigation may be left unconducted or limited. The legal conditions for those decisions must be assessed under the relevant subsections; this section does not mean that every report automatically results in a full investigation. Esitutkintalaki (805/2011), 3 luku 1 § — Rikoksesta tehdyn ilmoituksen kirjaaminen

FINNISH PRE-TRIAL INVESTIGATION ACT Esitutkintalaki (805/2011), 3 luku 1 § — Rikoksesta tehdyn ilmoituksen kirjaaminen Current consolidated statute · Chapter 3, Section 1 Alkuperäinen säädösteksti Kun esitutkintaviranomaiselle ilmoitetaan rikos tai tapahtuma, jota ilmoittaja epäilee rikokseksi, esitutkintaviranomaisen on viipymättä kirjattava ilmoitus. (27.3.2026/222) English translation — unofficial When an offence or event that the reporter suspects to be an offence is reported to a pre-trial investigation authority, the authority must register the report without delay. Information in the report may be added to an earlier report concerning the same offence. Reports concerning the same criminal matter may be handled under one report where this is justified by the nature of the suspected offences and the proper handling of the matter. If a report is unclear or incomplete, the reporter must, where necessary, be asked to clarify or supplement it. The report is not registered as a criminal report if the request is not complied with and the report is materially incomplete in view of the nature of the matter, or it is evident that no offence has been committed. Where necessary, a decision on non-registration must be made under Chapter 11, section 1. The duty to register also applies to a suspected offence that otherwise comes to the authority’s attention, unless the statutory conditions for waiving measures in Chapter 3, section 9(1) are met. An exception applies to certain low-level offences detected online where the investigation would evidently have to be suspended under section 13. An injured party must be given written confirmation of a criminal report they have made, containing basic information about the making of the report and the reported offence or event. The confirmation may be sent to the address provided by the injured party. This English translation is unofficial. The Finnish text on Finlex is authoritative. What this provision means Registration: a report made to the authority must generally be registered without delay. One report may cover related reports: the law allows information to be added to an earlier report and related reports to be handled together in justified circumstances. Therefore, the absence of a separate report number does not by itself prove that no report was made. Clarification: if a report is unclear or incomplete, the authority may need to ask the reporter to clarify or supplement it. Non-registration: the statutory conditions are limited; where required, non-registration must be documented by a decision under Chapter 11, section 1. Written confirmation: an injured party must receive confirmation of the criminal report they made, with basic information. Exception: subsection 3 contains a specific exception for certain low-level online-detected offences likely to be suspended under section 13. Questions this section helps answer Was a report received? Who made it, and what event did it describe? Was it registered separately or added to an earlier report? Was clarification requested? If it was not registered, is there a decision and a legal basis? If an injured party made the report, is there written confirmation? These are questions for checking the procedural record; this section alone does not establish what happened in any particular case.

English translation (unofficial) A prosecutor must bring charges for a suspected offence if the prosecutor considers that: the offence is punishable under law; the right to bring charges for it has not become time-barred; and there are probable grounds to support the guilt of the person suspected of the offence. Even where there are probable grounds supporting the suspect’s guilt and the other conditions in subsection 1 are met, the prosecutor may nevertheless waive prosecution under section 7 or 8, or another corresponding provision of law. This English translation is unofficial. The Finnish statutory text is authoritative. Legal context Section 6 does not define the charging threshold solely as probable grounds. Subsection 1 sets out three cumulative conditions: the offence must be punishable by law, prosecution must not be time-barred, and probable grounds must support the suspect’s guilt. Subsection 2 recognises statutory grounds on which prosecution may nevertheless be waived. This is the prosecutor’s charging decision, not the court’s final standard for determining guilt at trial. The assessment must be impartial and must consider relevant material both supporting and undermining the allegation.
