FINNISH PRE-TRIAL INVESTIGATION ACT
Esitutkintalaki (805/2011), 11 luku 1 § — Esitutkintapäätös
Current consolidated statute · Chapter 11, Section 1

(22.8.2014/672)

Edellä 1 momentissa tarkoitetusta päätöksestä on ilmettävä:

  1. päätöksen tehnyt viranomainen ja päätöksen tekemisen ajankohta;
  2. asianosaiset;
  3. asia;

(17.4.2026/269)

Esitutkintaviranomaisen päätöksistä on muuten voimassa, mitä niistä erikseen laissa säädetään.

English translation (unofficial)

A written decision must be made on not conducting a pre-trial investigation; discontinuing it under Chapter 3, section 9(1), section 10 or section 10a; and concluding it without submitting the matter for the prosecutor’s consideration. The same applies to another corresponding pre-trial investigation decision that may affect a party’s rights, interests or obligations.

The decision must state:

  1. the authority that made the decision and the date;
  2. the parties;
  3. the matter concerned;
  4. the reasons for the decision to the extent required by the nature and scope of the matter, and the provisions applied;
  5. the decision’s operative content; and
  6. contact details for the pre-trial investigation official who can provide further information.

The decision must be given to a party present during the investigation or sent by post to an address provided by that party or otherwise known to the authority. It may be withheld if disclosure would jeopardise the investigation of the offence concerned or a related offence. It must be given or sent without undue delay once that risk no longer exists. If there is a very large number of injured parties, notice may be given by public notification in accordance with section 62 of the Administrative Procedure Act.

Other provisions of law governing decisions of pre-trial investigation authorities also apply.

Legal context

This provision requires a written decision in the specified situations and in other corresponding investigation decisions that may affect a party’s rights, interests or obligations. The decision must identify the authority, date, parties and matter, state reasons to the extent required by the nature and scope of the matter, identify the legal provisions applied, state the outcome and provide contact details for further information.

The 17 April 2026 amendment (269/2026) expressly updated the required level of reasoning and the rules for notifying parties, including a public-notification option where there is a very large number of injured parties. The law permits delayed notification where immediate disclosure would harm an investigation, but requires notification without undue delay once that risk has passed.

Questions for checking the procedural record
  • Was a written decision required in the circumstances?
  • Does the document identify the decision-maker, date, parties and matter?
  • Does it provide reasons appropriate to the nature and scope of the matter and identify the provisions applied?
  • What decision was made, and who can provide further information?
  • Was notification delayed on the ground that disclosure could harm an investigation? If so, is there a record of when that risk ceased and notification followed?

These questions guide review of the file. The provision alone does not establish whether a decision was required or whether a particular decision complied with the law; that depends on the procedural circumstances and the full record.
