FINNISH PRE-TRIAL INVESTIGATION ACT

Esitutkintalaki (805/2011), 5 luku 3 § — Yhteistyövelvollisuus

Current consolidated statute · Chapter 5, Section 3

English translation — unofficial

As required by the nature or scope of the matter, the pre-trial investigation authority must inform the prosecutor of matters relating to the conduct of the investigation and investigative measures, and of the progress of the investigation. If the authority has notified the prosecutor of an offence under investigation, the investigation leader must consult the prosecutor about what is required to prepare the matter for consideration of charges and trial. In these cases, before concluding the investigation, the investigation leader must consult the prosecutor on whether the matter has been sufficiently clarified under Chapter 1, section 2, if the nature or scope of the matter so requires or if the investigation is to be concluded without submitting the matter to the prosecutor. The duty to notify in relation to coercive measures is governed by the Coercive Measures Act.

The investigation authority and the prosecutor must consult on questions relating to the organisation of cooperation during the investigation. Where necessary, they must consult on whether a request for a final statement is needed. They must also consult on the content of that request, any measures it may require, and whether the final statement creates a need to supplement the investigation.

The prosecutor must also participate in the investigation, to the extent necessary, to ensure that the matter is clarified as required by Chapter 1, section 2, including outside the situations referred to in subsections 1 and 2.

This English translation is unofficial. The Finnish statutory text is authoritative.

Legal context

The current text was amended by Act 269/2026. It sets out a structured cooperation duty: information-sharing; consultation on preparation for consideration of charges and trial; consultation before concluding the investigation in specified circumstances; consultation on the final-statement process and possible supplementary investigation; and the prosecutor’s necessary participation to ensure that the statutory investigative objectives are met. The consultation duties are subject to the conditions stated in the provision and should not be described as an unconditional duty to consult in every case.
