Esitutkintalaki (805/2011), 3 luku 2 §
Current consolidated statute · Chapter 3, Section 2

Suomenkielinen säädösteksti

English translation (unofficial)

If a report of an offence is made to a pre-trial investigation authority that is not responsible for conducting the investigation in that matter, that authority must immediately register receipt of the matter and forward the report and any other material collected in the matter to the competent pre-trial investigation authority. The competent authority must register the report without delay.

Legal context

This section addresses jurisdictional transfer. It distinguishes the first authority’s duty to record receipt and forward the report and any material from the competent authority’s duty to register the report without delay.

The provision is relevant when checking the path of a report between authorities. It does not by itself establish which authority received a particular report or whether the required steps were completed; those facts must be checked in the case record.

Questions for checking the procedural record
  • Which authority first received the report?
  • If it lacked competence to conduct the investigation, is there a record that receipt was registered immediately?
  • Was the report and any collected material forwarded to the competent authority?
  • Is there evidence that the competent authority registered the report without delay?
