Suomenkielinen säädösteksti

Sen lisäksi, mitä edellä säädetään ilmoittamisesta, esitutkintaviranomaisen on ilmoitettava asianomistajalle:

  1. mahdollisuuksien mukaan siitä, mihin toimenpiteisiin rikoksesta tehdyn ilmoituksen tai esitutkintaviranomaisen tietoon muuten tulleen rikoksen johdosta ryhdytään;
  2. asianomistajan rikoksesta epäiltyyn kohdistaman rangaistusvaatimuksen ja sen peruuttamisen merkityksestä, jos vaatimus on edellytyksenä esitutkinnan toimittamiselle tai jatkamiselle;
  3. viipymättä asianomistajarikoksen esitutkinnan toimittamisesta 3 luvun 4 §:n 3 momentissa tarkoitetussa tapauksessa.

Jos asianomistaja on kärsinyt rikoksen johdosta vahinkoa, josta hänellä on ilmeisesti oikeus saada korvausta rikosvahinkolain (1204/2005) nojalla, esitutkintaviranomaisen on lisäksi ilmoitettava asianomistajalle oikeudesta korvaukseen ja tarvittaessa opastettava häntä korvauksen hakemisessa.

English translation (unofficial)

In addition to the other notification duties laid down above, the pre-trial investigation authority must inform the injured party:

  1. where possible, of the measures taken in response to the reported offence or an offence otherwise brought to the authority’s attention;
  2. of the significance of the injured party’s demand that the suspected offender be punished, and of withdrawing that demand, if the demand is a prerequisite for conducting or continuing the investigation;
  3. without delay, that an investigation of an offence subject to a request for prosecution is being conducted in the situation referred to in Chapter 3, section 4(3).

If the injured party has suffered damage for which they apparently have a right to compensation under the Act on Compensation for Crime Damage, the authority must also inform them of the right to compensation and, where necessary, guide them in applying for it.

Legal context

This section addresses notifications to an injured party. It includes a qualified duty to inform them, where possible, of steps taken in response to a report; an obligation to explain the significance of a demand for punishment where such a demand is a prerequisite for investigation; and a specific duty to notify without delay in the situation cross-referenced in Chapter 3, section 4(3).

The first item is qualified by the words “mahdollisuuksien mukaan” (“where possible”). The section should not be paraphrased as an unconditional obligation to disclose every investigative step. Other statutory rules, including confidentiality and the risk of harming an investigation, may also be relevant.
