An accessible guide to Directive 2013/48/EU and its safeguards concerning timely access to a lawyer, confidential communication, participation during questioning, and remedies.
Directive 2013/48/EU establishes minimum rules on the right of access to a lawyer in criminal proceedings and European arrest warrant proceedings. It also addresses notification of a third party and communication with third persons and consular authorities during deprivation of liberty.
Suspects and accused persons must have access to a lawyer at a time and in a manner that allows practical and effective exercise of defence rights. Access must be provided without undue delay and, at the latest, from the earliest applicable point specified in Article 3, including before police or other authority questioning.
The right includes the opportunity to meet and communicate privately with the lawyer, including before questioning. It also includes the lawyer’s presence and effective participation during questioning, in accordance with national procedures that do not undermine the essence of the right.
The Directive sets conditions for waiving the right, including clear information and a voluntary, unequivocal decision, and provides for the possibility of revocation. Article 12 requires effective remedies where rights under the Directive are breached.
The relevant inquiry includes the person’s procedural status, when access to counsel was available, whether any waiver was valid, and whether the lawyer could participate effectively. The Directive’s application must be assessed alongside its scope and the applicable national implementation.
Question for procedural review
Before questioning or another relevant investigative act, was access to a lawyer available in a timely and effective way, and does the record establish any waiver or limitation?
