FINNISH PRE-TRIAL INVESTIGATION ACT

Esitutkintalaki (805/2011), 3 luku 1 § — Rikoksesta tehdyn ilmoituksen kirjaaminen

Current consolidated statute · Chapter 3, Section 1

(27.3.2026/222)

English translation — unofficial

When an offence or event that the reporter suspects to be an offence is reported to a pre-trial investigation authority, the authority must register the report without delay. Information in the report may be added to an earlier report concerning the same offence. Reports concerning the same criminal matter may be handled under one report where this is justified by the nature of the suspected offences and the proper handling of the matter.

If a report is unclear or incomplete, the reporter must, where necessary, be asked to clarify or supplement it. The report is not registered as a criminal report if the request is not complied with and the report is materially incomplete in view of the nature of the matter, or it is evident that no offence has been committed. Where necessary, a decision on non-registration must be made under Chapter 11, section 1.

The duty to register also applies to a suspected offence that otherwise comes to the authority’s attention, unless the statutory conditions for waiving measures in Chapter 3, section 9(1) are met. An exception applies to certain low-level offences detected online where the investigation would evidently have to be suspended under section 13.

An injured party must be given written confirmation of a criminal report they have made, containing basic information about the making of the report and the reported offence or event. The confirmation may be sent to the address provided by the injured party.

What this provision means

Registration: a report made to the authority must generally be registered without delay.
One report may cover related reports: the law allows information to be added to an earlier report and related reports to be handled together in justified circumstances. Therefore, the absence of a separate report number does not by itself prove that no report was made.
Clarification: if a report is unclear or incomplete, the authority may need to ask the reporter to clarify or supplement it.
Non-registration: the statutory conditions are limited; where required, non-registration must be documented by a decision under Chapter 11, section 1.
Written confirmation: an injured party must receive confirmation of the criminal report they made, with basic information.
Exception: subsection 3 contains a specific exception for certain low-level online-detected offences likely to be suspended under section 13.

Questions this section helps answer

Was a report received? Who made it, and what event did it describe? Was it registered separately or added to an earlier report? Was clarification requested? If it was not registered, is there a decision and a legal basis? If an injured party made the report, is there written confirmation?

These are questions for checking the procedural record; this section alone does not establish what happened in any particular case.
