EUROPEAN LEGAL FRAMEWORK // LEGAL REFERENCE
A structured reference for procedural monitoring and legal analysis.
At a glance
A structured guide to Article 6 of the European Convention on Human Rights, including fair hearing guarantees, presumption of innocence, and minimum rights of the defence.
Article 6 protects the right to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. In criminal proceedings, it also sets out specific minimum rights for anyone charged with a criminal offence.
Article 6 § 3(a) guarantees information, in a language understood, about the nature and cause of the accusation. Article 6 § 3(b) guarantees adequate time and facilities to prepare the defence. These safeguards are closely connected: meaningful preparation depends on knowing the case that must be answered.
Article 6 § 3(c) addresses defence in person or through legal assistance, including legal aid where the interests of justice require it. Paragraphs (d) and (e) concern the examination of witnesses and free assistance of an interpreter where necessary.
Article 6 § 2 requires that everyone charged with a criminal offence be presumed innocent until proved guilty according to law. The guarantee informs how authorities and courts approach the accused before a final determination.
Article 6 is applied in context. The specific guarantees in paragraph 3 are aspects of the broader right to a fair hearing in paragraph 1. A procedural review should identify the relevant guarantee, the stage at which it applied, and whether the person had a practical and effective opportunity to exercise it.
Question for procedural review
When assessing a criminal proceeding, what information was provided about the accusation, when was it provided, and what real opportunity did the defence have to prepare and participate?
